1. Company Details
These terms and conditions apply to all contracts entered into by Supermare Scaffolding Ltd (referred to as "the Company", "we", "us" or "our"), a company registered in England and Wales. Our principal place of business is Pyleigh Court Farm, Lydeard St Lawrence, Taunton, TA4 3QZ.
2. Quotations
All quotations provided by the Company are valid for 30 days from the date of issue unless otherwise stated. Quotations are based on the information provided by the customer at the time of enquiry. The Company reserves the right to revise a quotation if the scope of works changes or if access conditions differ materially from those described. A written or verbal acceptance of a quotation constitutes a binding agreement subject to these terms.
3. Commencement of Works
Work will commence on the agreed start date subject to weather conditions and the availability of materials and labour. The Company will endeavour to give reasonable notice of any delay. The Company accepts no liability for delays caused by circumstances beyond its reasonable control, including but not limited to adverse weather, third-party delays, or changes instructed by the customer.
4. Customer Obligations
The customer is responsible for:
- Ensuring clear and safe access to the site and the area of works at all agreed times.
- Obtaining any necessary planning permissions, listed building consents or neighbour agreements prior to commencement of works.
- Informing the Company of any known site hazards, including underground services, asbestos, or structural concerns.
- Ensuring that any third parties (such as roofers or builders) using the scaffold are made aware of and agree to these terms.
5. Scaffold Hire Period
Scaffolding is hired for the period stated in the quotation. If the scaffold is required beyond this period, the Company must be informed in advance and additional hire charges will apply. The customer must not alter, add to, remove or interfere with any part of the scaffolding structure. Any such interference may render the structure unsafe and will release the Company from any liability arising from such interference.
6. Payment Terms
Unless otherwise agreed in writing, payment is due within 14 days of the date of invoice. The Company reserves the right to charge interest on overdue invoices at the rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. The Company also reserves the right to recover any reasonable debt recovery costs incurred.
For domestic customers, a deposit of up to 50% of the contract value may be requested prior to commencement of works.
7. Cancellation
If the customer wishes to cancel or postpone an agreed booking, a minimum of 48 hours' notice must be given. Cancellations made with less than 48 hours' notice may be subject to a cancellation charge to cover any costs already incurred by the Company.
8. Damage and Liability
The Company carries full public liability insurance. The Company accepts liability for damage caused directly by our negligence. However, the Company does not accept liability for:
- Damage to underground services not notified to the Company prior to commencement of works.
- Consequential or indirect losses.
- Damage caused by third parties using the scaffold without our knowledge or consent.
- Acts of vandalism or theft of scaffold materials whilst on hire.
The customer is advised to ensure their own buildings and contents insurance provides adequate cover during the period of scaffold hire.
9. Health & Safety
All scaffolding erected by the Company is constructed in accordance with the relevant British Standards and industry best practice, including BS EN 12811. The Company's employees and operatives hold the appropriate CISRS qualifications. The customer must not permit children or unauthorised persons to climb on or use the scaffolding at any time.
10. Ownership of Materials
All scaffold materials remain the property of Supermare Scaffolding Ltd at all times. Upon completion of the hire period, the Company will arrange for the removal of all scaffold materials. The customer must not dispose of, sell, or transfer scaffold materials.
11. Disputes
In the event of a dispute, both parties agree to attempt to resolve the matter in good faith. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of England and Wales.
13. Changes to These Terms
The Company reserves the right to update these terms and conditions at any time. The current version will always be available on our website.
